Abstract
The definition of officially induced error, as seen throughout the progression of this article, is heavily dependent upon historical contexts and jurisdictions. However, in the context of the defence and its application in Ireland, it could be defined as such: A defence applicable in a criminal trial whereby the accused submits that they were acting on the legal advice offered by an authority, and that the accused, in acting upon that advice, had reason to accept that advice as true. This definition could be said to be a blending of the various versions of the defence across the multiple jurisdictions in which it is active. Each will be explored in the following sections.
